U/S 498A IPC, Husband or relative of husband of a woman subjecting her to cruelty.
Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. Section 498A of the Indian Penal Code required the bridegroom and his family to be automatically arrested if a wife complains of dowry harassment. The law was widely abused and in 2014, the Supreme Court ruled that arrests can only be made with a magistrate's approval. Women should use it for their safety and security purpose not to threat or demolish the dignity of a men or his relatives.
It is a powerful tool for tortured women whose in-laws, husband are being cruel to her but equally dangerous for the society and has been misused often. We help our client to understand all the legal technicalities related to this section.
