SUIT FOR DECLARATION

A declaration is the most common civil suits filed by the lawyers. Section 34 &35 of the Specific Relief Act lay down the law relating to declaratory decrees. A declaratory decree is a decree declaratory of a right which is doubtful or which required to be cleared or pronounced by the courts in favour of the person approaching the court. Any person can file a suit for declaration and injunction with regard to any legal character or rights as to any property against any person who is denying or interested to deny his title or such character
