Are Prenuptial Agreements Legal in India?

Indian law neither expressly recognises nor prohibits prenuptial agreements. There is no dedicated statute for them, except in Goa. Instead, they are treated as contracts under the Indian Contract Act, 1872. This means a prenup can be a legally valid contract if it meets the usual requirements under Section 10, such as free consent, lawful object and lawful consideration.

The complication is Section 23 of the Contract Act, which makes an agreement void if its object or consideration is unlawful, immoral or against public policy. Because Hindu marriage is regarded as a sacrament rather than a commercial contract, courts have often viewed agreements that anticipate divorce or alter marital duties as opposed to public policy. Are Prenups Enforceable? The Honest Position

This is where many websites overstate the position, so here is the realistic answer. Enforceability is limited and decided on a case-by-case basis. Indian courts generally will not enforce a prenup as a strictly binding contract the way Western courts do. However, they may:

  • Treat a fair agreement as persuasive evidence of the parties’ intentions, particularly on property and finances.
  • Uphold provisions that operate purely in the sphere of property division, treating them like a family settlement.
  • Refuse to enforce any term that defeats a statutory right or public policy.

So a well-drafted prenup is valuable for clarity, transparency and reducing future conflict, but it should be approached as a strong protective and advisory tool rather than a guarantee.

What Indian Courts Accept and What They Reject

Courts are more willing to respect agreements that deal with property and financial arrangements fairly. They tend to strike down clauses that:

  • Waive a spouse’s statutory right to maintenance or alimony, now under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 125 CrPC).
  • Predetermine child custody or child maintenance.
  • Encourage, anticipate or incentivise divorce.
  • Restrict basic marital rights or duties.

Child custody can never be fixed by contract. It is always decided on the welfare and best interest of the child at the relevant time.
